DEFINITION  

  • Estimated Prices Business
    All sales will be conducted in English and the estimated price printed in the catalogue is in Indonesian Rupiah and solely acts as a guide for prospective buyers. They are made on the basis of recent price list and take into account condition, rarity, quality, and others. Estimates do not include the buyer's premium.If "estimate on request" appears, please contact CEMPAKA's staff for further information.

    Reserved Price
    The reserved price is the minimum price the seller is willing to accept for each lot and below which the lot will not be sold.

    Buyer's Premium
    Buyer's premium is payable by the buyer of each lot purchased at the rate of 15% of the hammer price of the lot, in addition to the hammer price itself.

    BEFORE THE AUCTION

    Viewing
    Lots to be auctioned are usually on view for 2 (two) days prior to the sale during determined working hours. Buyers are strongly encouraged to inspect and examine lots thoroughly and to request for condition reports. There are statements of opinion and should not be relied on as statements of definitive facts.

    We remind prospective buyers that descriptions of property are not warranties and that each lot is sold "as is", even though they have undergone selection processes by those whom CEMPAKA consider to have the competency to do so. In order to assist you, CEMPAKA provides auction catalogues, containing information that could be used as references. The specifications written in the catalogues are correct, omitting all printing mistakes and if there are any differences in the information, the physical specification of the lots during the auction will be used as the reference.

    Registration
    All parties interested in participating in the auction must register as auction participants by completing and signing the registration form and providing identification. Registration can be done during viewing times or 30 minutes before the auction starts.

    AT THE AUCTION

    Bidding
    Bidding is executed in Indonesian Rupiah (IDR). It is conducted in an incremental price raise where the winner is the last highest bidder, above or equal to the reserved price. The auctioneer will accept bids from those present in the saleroom or absentee bidders participating by the telephone or by written bid left with CEMPAKA in advance of the auction. Every lot sold will be appointed to the names and addresses according to the registration number and cannot be transferred to other names and addresses.

    Occasionally, the auctioneer may vary the increments during the course of the auction at his discretion.

    Absentee Bid
    If an auction participant cannot attend the auction, CEMPAKA's staff can execute bids on his or her behalf. This service is free and confidential. In order to use the facilities, the participants should fill in the written bid forms and return them to CEMPAKA within 24 hours before the auction or by faxing it to (021) 316 2748. The highest bid that must be written in the form excludes the buyer's premium and unlimited bids are not allowed for written bids. If there should be any similar bids, the first bid received is the one accepted. To ensure satisfactory service to bidders, please ensure that CEMPAKA receives your bids at least 24 hours before the sale.

    Telephone Bid
    Bidding by telephone is possible for auction participants who are not able to attend the auction. This service must be confirmed in written instruction at least 24 hours before the auction and due to the limited phone lines or other technical constraints in our attempt to contact the auction participants, it is advised that the participants inform CEMPAKA about their maximum bids in writing. CEMPAKA will not be responsible for any unsuccessful bids. Bilingual staff are available to execute bids.

    Successful Bid
    The final bid reached or exceeded the reserved price is considered as sold and marked by the knock of the hammer by the auctioneer. The auctioneer will then note the winning bidder's registration number.If necessary, the auction process could be reopened under the judgment of the auctioneer.

    AFTER AUCTION

    Payments
    Buyers must settle payments within 3 (three) days after the auction at the latest by means of:

    1. Buyers must settle all payment by cash to Bank Central Asia's counter at the auction venue or by transferring to the account of
    2. P.T. Casa Anesa Realindo.
      Bank Central Asia MANGGA DUA RAYA Branch, Jakarta
      Account No: 335 301 7221

      at all Bank Central Asia Branch Offices by quoting bidder's name, the lot number bought, and the amount of the payments for easier administration processes. If between the provided time buyers do not settle the payments yet, they will be considered withdrawing.

    3. Buyers who do not settle payment as scheduled (default) will be put in the black list.

     

    Collection of Goods

    1. Goods can be collected after all payments have been made and effectively received by CEMPAKA within 7 (seven) days after the auction. Retrieval could be done by presenting the original receipt of the payment.
    2. Buyers must retrieve their purchased paintings at the determined place: Gedung Inter Asia Lantai 1. Jl. KH. Wahid Hasyim No. 96. Jakarta 10340.
    3. CEMPAKA could help with the shipment of the lots purchased. However, CEMPAKA is not responsible for any damages in the shipping process. If buyers would like CEMPAKA to help with the shipment, they should fill in the Delivery Painting Form, which can be obtained from CEMPAKA staff.
    4. Buyers are responsible for the cost of the shipment and the insurance of the paintings they have purchased.

    Storage and Insurance

    • CEMPAKA insures all sold painting maximum 7 (seven) days after the auction or until the time of retrieval by buyers, depending on which conditions occur first. If after more than 7 (seven) days, the lots have not been retrieved by buyers, CEMPAKA accepts no risks and responsibilities and buyers will also be charged with a Rp. 100.000,00 (IDR one hundred thousand) storage fee for every lot for each day over the period of time stated above.

    • Without any exceptions to the point above, all risk of damage and loss is in the responsibility of the buyers.

    Copyright
    The copyright in all images, illustrations, and written materials relating to the lot is and shall remain at all times CEMPAKA's property and shall not be used by the Buyer or anyone else without CEMPAKA's prior written consent.

    Force Majeure
    If a force majeure occurs after the auction, all loss becomes the responsibility of the buyers, not CEMPAKA's.

    Force Majeure means any incidents occur beyond control of both parties, which directly affect the lots, such as:

      1. Natural Disasters (Earthquakes, Flood, Storm, Volcanic Eruptions, Flash, and others)
      2. Social Outrages (Strikes, Riots, and others)
      3. War, Blockade, and Turmoil
      4. Government Policies in Monetary Sectors


    IMPORTANT NOTES

    Prospective buyers are advised to carefully check and observe the lots during the viewing times. Buyers are responsible for their own satisfaction in connection with the condition of the goods and other things according to the catalogues (specifications, colors, printings, and others). The judgment of the auctioneer becomes the reference during the auction proceeding, such as, in determining the opening prices, pricing increments or reopening offers. All buyers must read and understand the general terms and other information written in the catalogues or those announced during the viewing and auction.
